The short version. You pay a $199 reservation deposit now. It counts in full toward the phone’s price. You can cancel for a full refund any time before you make your final payment. We never charge the rest automatically. We expect to ship in Q2 2027, but that is an estimate, not a promise, and we can’t deliver the phone until the FCC has authorized it.
1. Who you’re dealing with
These terms are an agreement between you and TextGavel Inc., a Delaware corporation operating as Cyclon (“we”), 100 Van Ness Ave, Apt 2203, San Francisco, CA 94102. By pre-ordering, you agree to them and acknowledge our privacy notice. You must be at least 18 and have a delivery address in the United States.
2. What you’re reserving
Your reservation deposit holds your place in line for one Cyclon phone. It is not the sale of a finished product, and you don’t own a phone until you’ve made your final payment and we’ve delivered it. Your place is confirmed once Stripe reports your payment and we’ve sent your confirmation. Your place in line is not a guaranteed ship date. We may refuse or cancel a pre-order for fraud, abuse, a pricing error, a legal restriction or lack of availability, and we then refund you in full.
3. Reservation deposit, full price and final payment
The reservation deposit is $199, and all of it counts toward the phone’s price. The full price isn’t set yet. Before the phone ships, we email you the full price and a payment link, along with any taxes that apply. Shipping within the US is free. We never charge the rest automatically: you choose whether to pay. You have 30 days from that email. If you don’t pay, we may cancel your pre-order after telling you, and we refund your reservation deposit.
4. Cancelling and refunds
You can cancel for any reason, at no cost, any time before your final payment. Email contact@cyclon.ai from the address you used at checkout, with your order number. We refund your payment method within 7 business days, though your bank may take longer to show it. If you received a first-batch Pixel, section 8 also applies. Once you make your final payment, the purchase terms we give you before that payment apply instead.
5. Shipping estimate and delays
We expect to ship in Q2 2027. This is our good-faith estimate, not a guaranteed date. Hardware development, testing, certification, manufacturing and supply can change it. If we learn we can’t ship within the estimate, we email you a revised date, or tell you we can’t give one, and you can choose to wait or cancel for a full refund. If we don’t hear back when the law requires your agreement, or if we decide we can’t deliver, we cancel and refund you without you having to ask.
6. FCC notice
The Cyclon phone has not been authorized under FCC rules yet. It is subject to those rules, and we can’t deliver it until it is authorized. FCC rules don’t address consumer protection, contract or other provisions that may apply to your pre-order. If it isn’t authorized, we cancel your pre-order and refund your reservation deposit in full.
7. Product changes
The Cyclon phone is still in development. Images, including the 3D phone on our site, show concept hardware. Its design, specifications and features may change. We describe the phone before your final payment. If a change materially affects what you reserved, we tell you, and you can cancel for a full refund.
8. The first batch and the closed beta
The first pre-orders join our closed beta. While the first batch lasts, each of them also gets one refurbished, unlocked Google Pixel 8a running Cyclon OS, shipped free within the US within 30 days of your order. If we can’t ship it in time, we email you, and you can wait or cancel for a full refund. It’s a bonus for taking part in the beta, not something you pay for separately, and it isn’t the Cyclon phone. The first batch is limited and first come, first served. Your confirmation says if you’re in it. If orders in a rush go past its size, we tell you, and you can keep your pre-order without the Pixel or cancel for a full refund.
Cyclon OS is beta software: we’re still improving it, so it changes with updates and can have bugs or unfinished features. It comes with its own privacy information, which we’ll give you before you use it. During the beta, no subscription is required and AI usage is included, within fair-use limits we may set. If you share feedback, we may use it to improve Cyclon without owing you anything. We warrant the Pixel against defects in materials and workmanship for one year from delivery. This doesn’t cover accidental damage, water damage or unauthorized repairs. Google and Pixel are trademarks of Google LLC; Cyclon is not affiliated with Google.
The Pixel is a bonus for joining the closed beta. If you change your mind after it ships, send it back at our cost and we’ll refund you. Before your final payment, we’ll tell you whether you keep it.
9. Emails
You agree to get records and notices by email at your checkout address, including your confirmation, delay notices, payment requests and refunds. Please keep it current. You can save or print this page, ask for a paper copy, or withdraw this agreement by emailing us. We may need to cancel and refund your pre-order if we can’t reach you by email.
10. Your rights and our liability
We give you the return policy and any warranty for the Cyclon phone before your final payment. Nothing in these terms limits refund, chargeback, warranty or other rights you have under the law. To the extent the law allows, we aren’t liable for indirect or consequential damages from your pre-order, and our total liability for it won’t exceed what you paid us for it. These limits don’t apply to fraud, willful misconduct, or anything the law doesn’t let us limit.
Delaware law governs these terms, but you keep any consumer protections of your home state that can’t be waived. Nothing here requires arbitration or stops you from using small-claims court.
11. Changes and contact
We may update these terms for future pre-orders. If a change materially affects yours, we tell you and you can cancel for a full refund. You can’t transfer a pre-order without our written permission. Questions? Email contact@cyclon.ai.
